This is a great example from Sainsbury’s of an email sign up as part of the account creation process.
Although the wording could perhaps be more benefit-driven and clear that it’s via email that the information will be received, this form clearly links to the Privacy Policy and breaks the norm by offering a non-checked yes / no mandatory sign up option (the form cannot be completed without selecting an option). This helps to break through a default choice and make the user actually think about their selection; they are much more likely to select yes therefore (if the wording is right to encourage them to do so of course).
